International Investment Under The New US-Mexico-Canada Agreement: Right Without A Remedy

Join MBBI Board Member John Keenan for an engaging presentation that will focus on the change in dispute resolution which negotiations have brought about in the multi-lateral North American Free Trade Agreement and which are memorialized in the United States-Mexico-Canada Agreement. More particularly, the discussion will highlight the fundamental alteration of investment treaty arbitration provisions which are contained in the new USMCA.
The presentation will provide a side-by-side comparison of the rights and remedies in the two relevant multilateral agreements. Other typical other international treaties that the United States has entered into with third-party countries will be discussed.
Leading ICSID investor arbitration cases will be discussed suggesting reasons why the highlighted changes came about after negotiations. The presentation will discuss future trends in the negotiation of international treaties to which the United States is a party.
Finally, the presentation will discuss practical aspects for international practitioners to aid in advising investors.

John Keeenan:
John J. Keenan is admitted to practice in law in New York, California and Ontario, Canada. He is a commercial, corporate lawyer, arbitrator, and mediator, and has more than twenty years’ experience regarding international commercial arbitration and international mediation. John operates a cross-border commercial law practice serving international corporations. He received his undergraduate degree (B.A.) from Queen’s University at Kingston, Ontario. He has trained in law in Canada, the United States, and the U.K. John graduated with an LL.M. from Queen Mary University of London in International Commercial Arbitration and Investment Treaty Arbitration. He currently serves as a Member of the Board of Directors of Mediators Beyond Borders International.
